In face of this fact, the present work will try to trace in an objective way the limits of the illustration of the pollutant indirect, drawing criteria for application of the pollutant-payer's beginning. For so much, enough juridical fundamentation is looked for to disentangle of the compared right, and to analyze the concept of the legislation homeland of Pollutant Indirect, to the light of juridical institutes already consecrated, as the enclosure of applicable causal chain to the species and the limits traced by the constitutional beginning of the proportionality. Like this, the present study intends to disentangle of the environmental civil responsibility limitless of the backer - consecrated in inconsistent juridical speeches, based in a passionate way -, through the technical analysis of the indispensable element to the characterization of the duty of compensating the environmental damage: the causal connection and your limits
